Terms of Service

These Terms of Service are an agreement between you and App Machina LLC ("App Machina," "Licensor," "we," or "us"), 26500 Agoura Road, Suite 102-810, Calabasas, CA 91302, United States. They govern your use of Catch Master: Fishing Game ("Catch Master" or the "Licensed Application") on Google Play and the Apple App Store, its related services and this website. By using Catch Master, you agree to these terms and to our Privacy Policy.

Eligibility

Catch Master is intended for adults aged 18 or older. By playing, you confirm that you meet this age requirement.

Virtual items and purchases

Catch Master is intended for an adult audience (18+) and for amusement purposes only. It does not offer real money gambling or an opportunity to win real money or prizes of real-world value. Practice or success at social gaming does not imply future success at real money gambling. Catch Master is free to download and play and offers optional in-app purchases of virtual items with real money.

Catch Master uses virtual items such as coins, spins, cards, baits, pets and tackle boxes. Virtual items are licensed to you for play inside the game, have no cash value, and cannot be exchanged for money, goods or anything of real-world value, or transferred to another player outside the game's own features. The reels, raids, attacks and fishing trips are game features that simulate luck for amusement; they pay out only virtual items, and no cash prize or prize of real-world value is ever offered. Tackle boxes contain random cards.

Purchases are processed by Google Play or the Apple App Store under their own terms, and refunds follow the policy of the store where you bought. We may change, rebalance or retire virtual items and game features as the game evolves.

Your account and fair play

You can play as a guest or connect Facebook, Sign in with Apple or Sign in with Google to keep your harbor across devices. You are responsible for the accounts you connect. When you play, you agree to:

  • choose captain and team names that are free of hate, harassment, sexual content and other people's personal information;
  • treat other players with respect, and use Report and Block in the game when someone does not;
  • play with the game as we publish it, with no cheats, bots, modified clients, exploits of bugs or tools that change balances or outcomes;
  • keep to one account for yourself, with no selling, buying or sharing of accounts or virtual items for money.

Account suspension and termination

We may suspend or terminate an account, remove its virtual items, or rename a captain or team, when we reasonably believe the account broke these terms, put other players at risk, or acted against the law. Where we can, we tell you by email or in the game and give you a way to respond by writing to support@appmachina.com. Virtual items have no cash value, so they are not refunded when an account is terminated for breaking these terms, except where the law requires it.

You can stop playing at any time and ask us to delete your account as described on the account deletion page. Deleting your account permanently removes your harbor and virtual items.

Licensed Application End User License Agreement

Apps made available through Google Play and the Apple App Store are licensed to you, and ownership of them stays with the Licensor. Your license to each App is subject to your prior acceptance of either this Licensed Application End User License Agreement ("Standard EULA"), or a custom end user license agreement between you and the Application Provider ("Custom EULA"), if one is provided.

Scope of license

Licensor grants to you a nontransferable license to use the Licensed Application on any Android or Apple-branded devices that you own or control, as permitted by the usage rules of the store where you obtained it. The terms of this Standard EULA will govern any content, materials, or services accessible from or purchased within the Licensed Application as well as upgrades provided by Licensor that replace or supplement the original Licensed Application, unless such upgrade is accompanied by a Custom EULA.

Consent to use of data

You agree that Licensor may collect and use technical data and related information, including but not limited to technical information about your device, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the Licensed Application. Our Privacy Policy describes this in full.

Termination of the license

This Standard EULA is effective until terminated by you or Licensor. Your rights under this Standard EULA will terminate automatically if you fail to comply with any of its terms.

External services

The Licensed Application may enable access to Licensor's and/or third-party services and websites (collectively and individually, "External Services"), such as Facebook, Apple and Google sign-in. You agree to use the External Services at your sole risk.

No warranty

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION AND ANY SERVICES PERFORMED OR PROVIDED BY THE LICENSED APPLICATION ARE PROVIDED "AS IS" AND "AS AVAILABLE."

Limitation of liability

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER.

Export restrictions

You may not use or otherwise export or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which the Licensed Application was obtained.

Commercial items

The Licensed Application and related documentation are "Commercial Items", as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation".

Governing law

This Agreement and the relationship between you and Licensor, App Machina LLC, a Delaware limited liability company, are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. The courts located in Delaware will have jurisdiction over disputes, unless applicable law gives you the right to bring claims elsewhere. Nothing here limits non-waivable consumer rights you may have where you live.

Changes to these terms

We may update these terms from time to time. We post the new version on this page and update the "Last updated" date.
